These Terms of Service ("Terms") govern your access to and use of VirtualStaging.tools (the "Service"), operated by NexusGrowth, LLC ("Company," "we," "us"). By accessing or using the Service, you agree to these Terms.

1. Service Overview

VirtualStaging.tools provides AI-powered virtual staging and related image processing services for real estate marketing and visualization.

2. Eligibility and Authority

You must be at least 18 years old to use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. Accounts and Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately if you suspect unauthorized access.

4. Subscriptions, Billing, and Credits

Paid plans are billed in advance on a monthly or annual basis.
Monthly plans: credits refresh each month and do not roll over.
Annual plans: credits are provided as an annual pool available for use throughout the annual term.
Prices, plan features, and credit amounts may change with notice.

5. Refunds

If you experience technical issues or are not satisfied with initial results, contact support within 7 days of your first charge for a resolution or refund. Refunds for renewals, partial periods, or used credits are generally not provided unless required by law.

6. Customer Content and License

You retain ownership of images and other content you upload ("Customer Content"). You grant us a limited, non-exclusive, worldwide license to host, process, and store Customer Content solely to provide and improve the Service.

You represent and warrant that you have all necessary rights and permissions to upload Customer Content and to use it for virtual staging and marketing purposes.

7. Output License and Disclosure

For paid plans, we grant you a perpetual, worldwide, royalty-free license to use generated outputs for commercial real estate marketing, listings, and advertising.

You are responsible for complying with applicable laws and MLS rules, including any required disclosure that images are virtually staged or AI-generated.

8. Prohibited Uses

You agree not to use the Service to:

Upload content you do not have the right to use.
Mislead consumers or misrepresent a property.
Violate applicable laws, regulations, or third-party rights.
Interfere with the security or integrity of the Service.

9. Data Retention

Our standard retention periods are:

Free originals: 24 hours
Paid originals: 30 days
Free outputs: 7 days
Paid outputs: retained while your account remains active; after cancellation or account closure, we may retain outputs for up to 90 days.

You may delete projects within your account. Some data may remain in backups for a limited period.

10. Third-Party Services

We use third-party providers for hosting, storage, analytics, and payments (e.g., Cloudflare, Google Analytics, Stripe, Vercel). Your use of the Service may be subject to their terms and policies.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available." We disclaim all warranties, express or implied, including any warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Limitation of Liability

To the maximum extent permitted by law, our total liability for any claims arising out of or relating to the Service will not exceed the fees you paid to us in the three (3) months preceding the claim. We are not liable for any indirect, incidental, special, consequential, or punitive damages.
